The matter is taken up through video conferencing.
Shri Hitesh Pachori, learned counsel appears for the petitioner.
Shri Ashish Agrawal, learned counsel appears for the respondent.
Petitioner by way of present petition seeks following relief:-
"(i) Issue a writ, order or direction in the nature of Mandamus commanding & directing the respondents to refund Rs. 19,50,000/- deposited by the petitioner for the purchase of property [shop No. 1 Lower Ground Floor, Surendra Arcade Ayodhyakunj, VIP Road, Arjun Nagar, Agra] published in E-auction sale notice dated 23.05.2019.
(ii) Issue a writ, order or direction in the nature of Mandamus directing the respondents to pay the interest @ of 12% upon the amount deposited by the petitioner, with the bank, from 09.07.2019 till the date of actual payment/ refund."
However, instead of pursuing the relief sought in the petition, the petitioner seeks liberty to withdraw this petition and file an application to intervene in the Writ C No. 27306 of 2019.
Prayer is allowed.
Petition stands dismissed as withdrawn with the said liberty.
