Heard Sri K.N. Tripathi, learned counsel for the petitioner and Sri G.P. Singh, learned AGA for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for quashing the N.C.R dated 18.5.2019, registered as NCR No.41 of 2019, u/s 323, 504 IPC, P.S. Bachhrayun, district J.P. Nagar.
Learned AGA states that the offence in question is bailable one to which learned counsel for the petitioner could not give satisfactory reply.
After having examined the submissions advanced by learned counsel for the parties, we are of the opinion that no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the FIR as the offence in question is bailable one.
The petition lacks merit and is, accordingly, dismissed.
