Heard learned counsel for the petitioner and Shri Sanjay Kumar Singh, learned Standing Counsel.
The petitioner is before this Court assailing the order dated 30.11.2018 passed by second respondent in Appeal No.C201813000001816 (Abid Husain v. State of U.P. & Ors.) by which the stay application therein has been rejected and also for a direction to second respondent to decide the aforesaid appeal in question expeditiously.
The Court has proceeded to examine the record in question and find that admittedly the appeal in question is pending consideration and as such the Court is not inclined to interfere in the matter at this stage. However, in the interest of justice, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the appellate authority to decide the aforesaid appeal in question in accordance with law preferably within six weeks from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned.
