Case called out in the revised list.
No one appears on behalf of revisionist to press this criminal revision. Learned A.G.A. representing opposite party no. 1 is present. This Court passed the following order on 18.5.2017:
"1. List has been revised. None appears to press this Criminal Revision even in the revised call.
2. Names of the counsel for the revisionist have been shown in the cause list, but no one has appeared even to make a request for adjournment.
3. This Criminal Revision arises out of allowing of Revision No. 442 of 2002 by judgment and order dated 24.04.2003 passed by the Sessions Judge, Jalaun at Orai filed by opposite party No. 2 ? Smt. Marjeena against the judgment and order dated 17.10.2002 passed by the Judicial Magistrate/Civil Judge (Junior Division), Jalaun at Orai in Criminal Misc. Case No. 6 of 2002 (Abid Husain Vs. Marjeena) under Section 127 (3) Cr.P.C.
4. This Court while entertaining the revision on 23.07.2003 has directed that the maintenance amount shall continue to be paid by the revisionist to the opposite party No. 2 till further orders of the Court by depositing it in the learned Court below, but the opposite party No. 2 shall have no right to withdraw the said amount till further orders of the Court.
5. Notice was issued to the opposite party No. 2 which, it has been reported by the office, has been duly served upon the opposite party No. 2 on 27.09.2016. None appears for the opposite party No. 2 also in this case. No Advocate has filed his power on behalf of the opposite party No. 2.
6. Since Criminal Revision cannot be dismissed for want of prosecution, one last opportunity is given to the counsel for the revisionist to appear and assist this Court on the next date of listing.
7. List on 6th of July, 2017, on which date in case the counsel for the revisionist does not appear, then, this Court will itself peruse the material on record and pass appropriate order on the Criminal Revision. "
Today again, when the case has been taken up in the revised list, learned counsel for the revisionist is not present.
Accordingly, the present criminal revision is dismissed for want of prosecution.
