Heard learned counsel for the applicant and Sri Amrendra Nath Singh, learned counsel for the opposite party no. 6.
This Court vide order dated 9 February 2009 passed the following order:
"The petitioner may approach the appropriate forum for his mutation, as per the order of District Judge.
The writ petition is accordingly dismissed."
On specific query, learned counsel for the applicant submits that in 1978 plot belonging to the applicant was declared surplus and thereafter, the name of the State was mutated in the revenue record. It is urged that after passing of the order of the writ Court name of the applicant has been entered in the revenue record.
Development Authority submits that pursuant to the writ Court order nothing was done, however, it is informed by the learned counsel for the applicant that the State has transferred the land to Central Industrial Security Force (C.I.S.F.) and thereafter the applicant has been dispossessed.
In view thereof, since complicated questions of fact and law are involved, which cannot be gone into in contempt jurisdiction.
The contempt petition is, accordingly, disposed of as withdrawn with liberty to the applicant to take remedy before the appropriate forum in accordance with law after impleading all aggrieved parties including C.I.S.F.
