Petitioner challenges Ext.P6, a revisional order passed by the Government on 07.03.2014 confirming the order passed by the Revenue Divisional Officer in terms of Ext.P1. Ext.P1, apparently, is an order passed by the Revenue Divisional Officer exercising power under Section 13 of the Kerala Conservation of Paddy Land and Wet Land Act, 2008. Section 13 does not give any power of the Revenue Divisional Officer to pass such an order directing the petitioner to restore the property to its original position. Competent authority is the District Collector. In that view of the matter, this writ petition is only to be allowed. Accordingly, Exts.P1 and P5 are set aside. Revenue Divisional Officer, the 2nd respondent is directed to forward the files in this regard to the District Collector for taking appropriate action in accordance with the procedure prescribed and until such time, the petitioner shall maintain status quo with respect to the property in question. The entire procedure shall be completed within a period of three months from the date of receipt of a copy of this judgment.
