Heard Sir Rahul, learned counsel for the applicant and learned A.G.A. for the State.
The present application has been filed under Section 482 Cr.P.C. for quashing of the impugned charge-sheet dated01.01.2018, the cognizance order dated 06.04.2018, arising out of Case Crime No. 0470 of 2017, under Section 3/4 of Dowry Prohibition Act, P.S.- Mubarakpur, District- Azamgarh, Case No. 2315 of 2018, State Vs. Abhishek & Others, pending in the court of C.J.M., Azamgarh.
Learned counsel for the applicant submits that Court below has issued bailable warrant as well as non-bailable warrant. In stead of keeping this matter pending, it would be better that the non- bailable warrants are stayed and the applicant is directed to appear before the trial court on or before 13th December, 2018, till he applies for regular bail, apply for fresh, no coercive action shall be taken pursuant to the bailable warrant or non- bailable warrant, if at all issued by the court below.
This order will remain operation qua the Case No. 2315 of 2018 which is pending before the C.J.M. Azamgarh, till 30th December, 2018 on or before which date the trial Court shall decide his bail application on which the petitioner shall file on or before 13th December, 2018.
According, the application is disposed of.
