Abhishek Tewari vs State Of U.P. And Others

High Court Of Judicature at Allahabad|30 June, 2010

JUDGMENT / ORDER

Petitioner was issued an admit card for appearance in the examination to be held for the post of Basic Health Worker scheduled for 12.06.2010. The petitioner reached the examination centre on the date and time fixed. However, her Roll Number was not shown in the notice board of the Examination Centre. It took more than an hour for the Examination Superintendent to allocate a seat to the petitioner for undertaking the examination. Therefore, the total time available to the petitioner for answering the question paper was arbitrarily reduced. This according to the petitioner has resulted in her being deprived of fair chance to compete with others. Being aggrieved, the petitioner filed a representation before the respondent no. 2 on 15.06.2010, which has not yet been considered. The petitioner has approached this Court for a mandamus commanding the respondent no. 2 to consider the representation of the petitioner.
In the facts and circumstances of this case, without entering into the correctness or otherwise of the allegations made in the present writ petition, this petition is disposed of with a request upon the respondent no. 2 to consider and decide the representation of the petitioner dated 15.06.2010 by means of a reasoned speaking order in accordance with law preferably within four weeks from the date a certified copy of this order along with a self attested copy of the representation is filed before him.
