The present petition has been filed for a direction upon the Additional Civil Judge (Senior Division)/Additional Chief Judicial Magistrate, 6th, Allahabad to decide Execution Case No.2 of 2013 within stipulated period.
From the order sheet of the proceeding it appears that during the period between 2013 to 2015, the Presiding Officer of the Court was either on leave or the court was lying vacant.
From the last order dated 28.03.2018, it appears that the court is vacant and, therefore, 14.05.2018 is the date fixed.
In view of the above, this Court considers it appropriate to dispose of this petition by giving liberty to the petitioner to apply to the District Judge concerned for transfer of the proceeding to another court of competent jurisdiction if the court concerned continues to remain vacant. In case the court is available, it shall be open to the petitioner to file an application for expediting the case.
With the aforesaid liberty, the petition is disposed of.
