Heard Sri Maya Ram, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Sri Maya Ram, learned counsel for the petitioner submits that the petitioner undertakes to submit an application, for the copy of the answersheet in the subject of Mathematics (Theory) in the High School Examination-2019, in the prescribed proforma after paying the requisite fee, within a period of one week.
The only prayer made, by Sri Maya Ram, learned counsel for the petitioner, is that the aforesaid representation of the petitioner, be decided within a stipulated period of time.
Learned Standing Counsel does not have any serious objection to the aforesaid prayer subject to payment of usual charges.
No useful purpose would be served by keeping this writ petition pending. With the consent of parties, the writ petition is being disposed.
Matter is remitted to the respondent no. 2, Secretary, Madhyamik Shiksha Parishad, U.P., Prayagraj.
A writ of mandamus is issued commanding the respondent no. 2, Secretary, Madhyamik Shiksha Parishad, U.P., Prayagraj, to decide the representation of the petitioner for copy of the answersheet in the subject of Mathematics (Theory) in the High School Examination-2019, in accordance with law within a period of one month, from the date of receipt of a certified copy of this order, along with a copy of the application in the prescribed proforma and deposit of the requisite fee.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor the claim of the petitioner has been judged on merits. It is for the competent authority to do so after independent application of mind in accordance with law.
The writ petition is disposed of finally.
