Heard learned counsel for the parties.
By the instant writ petition, petitioner seeks the following relief:
"1. Issue a writ, order or direction in the nature of mandamus directing the respondent to appoint the petitioner on the suitable post as per the educational qualification of the petitioner under the Dying-in-Harness Rules, 1974."
Learned Standing Counsel submits that the grievance of the petitioner shall be redressed by the second respondent- Ziladhikari Varanasi, District- Varanasi, in accordance with law.
In view thereof, on consent, the writ petition is disposed of with direction that the petitioner shall file a fresh representation before the second respondent- Ziladhikari Varanasi, District- Varanasi , within two weeks from the date. In the event, such representation filed by the petitioner, it is expected that the same shall consider and decide by a reasoned and speaking order, in accordance with law, expeditiously within a period of six weeks from the date of receipt of representation along with a copy of the writ petition.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
