Heard learned counsel for the petitioner. Sri Amrish Sahai, learned counsel has accepted notice on behalf of respondents.
The petitioner is aggrieved by the non-payment of the education loan interest subsidy. The matter was taken up by the ombudsman of the bank and in pursuance to his decision, the bank vide letter dated 22.06.2018 has acknowledged that the education loan interest subsidy of the petitioner shall be processed by it as and when the Government of India opens the scheme portal for previous years left over cases.
In view of above, the bank is not denying the processing of the education loan interest subsidy admissible to the petitioner but it is dependent upon the Government of India.
The petitioner is not claiming any relief from the Government of India. It has not been made party in the petition.Therefore, the petitioner has to wait for the opening of the claim portal by the Government of India whereupon the bank will process and make the payment of loan interest subsidy to him.
It also appears from annexure-6 to the writ petition that the bank has raised claim with regard to the repayment of the loan amount by the petitioner and in that connection proceedings have been initiated before the Lok Adalat which means there some dispute relating to the loan transaction its repayment and interest subsidy which cannot be resolved or adjudication in exercise of discretionary jurisdiction.
Accordingly, the Writ Petition stands dismissed with no order as to costs.
