Heard learned counsel for the petitioner and the learned Standing counsel.
The petitioner is a judicial officer in service of the State of U.P. He was due for promotion as Additional District Judge but on account of pendency of some departmental enquiry he was not given the benefit of the said promotion. He has been exonerated from the said enquiry as has been informed to him vide order dated 18th May 2018.
The petitioner has thus preferred this petition seeking direction for granting him notional promotion as Additional District Judge (Fast Track Court) on stop gap arrangement and regular promotion as ADJ w.e.f. the date on which juniors to him have been promoted with all consequential benefits.
Learned counsel for the petitioner at the very outset submits that he is not seeking notional promotion as ADJ (FTC) and that his prayer in the writ petition is confined to the regular promotion on the post of ADJ w.e.f. the date juniors to him have been promoted on the said date.
In this regard, the petitioner has already submitted representation dated 3.12.2018 to the Registrar General of the High Court which is said to be pending consideration.
Sri Ashish Mishra, learned counsel for the respondents submits that the aforesaid representation of the petitioner is under active consideration and that it would be decided in due course.
In view of the aforesaid facts and circumstances, we dispose of the writ petition with the expectation that the respondent would ensure that the above representation of the petitioner for grant of regular promotion as ADJ w.e.f. the date on which juniors to the petitioner were promoted is decided most expeditiously as far as possible within a period of three months.
The petition is disposed of.
