The prayer made in the instant petition is for issuing direction to the court below to decide Petition No.280 of 2009 for dissolution of marriage between the parties within a specified time frame.
The parties are Hindu and the petition is evidently under the provisions of the Hindu Marriage Act, 1955.
Counsel for the petitioner has made statement at the Bar that the petitioner is regularly paying the interim maintenance to the opposite party as awarded by the trial court. He further states that if any amount is due, the same shall be positively paid within two weeks.
Section 21-B of the Hindu Marriage Act specifically provides that all proceedings under the Act should be held on a day to day basis and effort should be made to conclude the proceedings as far as possible within six months from the date of service of the petition on the respondent.
In view of the aforesaid provisions under the Act, I am of the opinion that no further direction is required.
The petition is accordingly disposed of.
