The instant contempt application has been filed for alleged violation of the order dated 23.10.2017 corrected on 02.02.2018 in writ no. 39418 of 2017.
The order dated 23.10.2017 corrected on 02.02.2018 is an interim order passed in the writ petition.
It is pointed out by learned Standing Counsel that writ itself has been dismissed on 09.01.2019.
In view of the above, the instant contempt application has been rendered infructuous.
Counsel for the applicant points out that judgment passed by the writ Court is under challenge in Special Appeal and a fresh interim order has been granted in favour of the applicant.
In opinion of the court, in case the respondents are not complying with the interim order passed in Special Appeal, it may give rise to a fresh cause of action but on basis of the said order the instant contempt application cannot be pursued any further.
The instant contempt application is dismissed as infructuous.
