Heard learned counsel for the parties.
The primary prayer made in the writ petition, reads thus:
"(i) Issue a writ order or direction in the nature of certiorari quashing the impugned First Information Report dated 13.02.2017 giving rise to Crime No. 0124 of 2017 under section 498A, 323, 325, 504 I.P.C. and 3/4 D.P. Act, Police Station Khurja Nagar, District Bulandshahar, (contained in Annexure No. 1 to this writ petition). "
Mr. Syed Ali Murtaza, learned AGA, on instructions, submits that a Charge Sheet bearing no. 38/2018 dated 29.01.2018, has already been filed, and in view thereof, this petition renders infructuous.
The petition is, accordingly, disposed of as infructuous. It is, however, open to the petitioner to take appropriate remedy, if he so desires and is advised, for appropriate relief.
