Heard learned counsel for the petitioner and Shri Habib Ahmad for the respondent-bank.
At the very outset, learned counsel for the petitioner submits that he wants to make payment of the outstanding dues of the bank in respect of which recovery citation had been issued.
Counsel for the respondent-bank submits that he has no objection, in case, the payments are made by the petitioner within stipulated period of time.
In view of the above consent of the counsel for the parties, no coercive measure shall be taken against the petitioner in the matter of recovery provided:-
(a) The petitioner shall deposit Rs. 1,00,000/- by 30.6.2019 and Rs. 1,00,000/- by 31.7.2019 with the bank and on payment of second deposit being made the bank shall issue statement of accounts within two weeks regarding the outstanding dues alongwith interest to be payable by the petitioner after deducting the amount already paid.
(b) On getting the statement of accounts from the bank, the petitioner shall make deposit of the outstanding dues within four bi-monthly installments. However no recovery charges shall be made from the bank in respect of the recovery citation issued.
It is further made clear that in the event of the default of either of the two conditions provided hereinabove the interim protection granted under this order shall cease to exist and the respondent-bank shall be at liberty to proceed for recovery of amount as per law and no further writ petition or application shall be entertained.
