----------------------- Petitioner's vehicle bearing Reg.No.KL-27-B-6158 has been seized alleging that the vehicle is used for the reclamation of the paddy land in violation of Kerala Conservation of Paddy Land and Wet Land Act, 2008 (Act 28 of 2008 for short). This vehicle was released based on interim order on executing a bond for the value of vehicle as fixed by the 1st respondent. Petitioner's case is that this property is not a paddy field. The petitioner relies on Ext.P4 data bank entry. It is stated in Ext.P4 that this is a reclaimed land. In view of the above no offence can be made out against the petitioner under Act 28 of 2008. Accordingly all proceedings against the petitioner are set aside. The petitioner is at liberty to use the vehicle.
