All the petitioners claim that they were Assistant Teachers in Primary School and they have been promoted on the post of the Head Master/Assistant Teachers in the Senior Basic School. However, by the impugned order, they have been reverted to their substantive posts and they have joined the new place of posting.
Learned counsel for the petitioners submits that by the order dated 28.10.2016 issued by the Secretary, U.P. Basic Shiksha Parishad, Allahabad, some similarly placed persons have been allowed to continue on the posts on which they have already promoted and joined.
From the record, it appears that the petitioners for redressal of their grievance have already filed representation before the authority concerned on 17.11.2017.
Heard learned counsel for the petitioners, learned Standing Counsel for the State respondents and Sri Chandra Prakash Rai for the respondent nos. 2 and 3 and with their consent the writ petition is finally disposed of.
Having due regard to the fact, I am of the view that end of justice would be subserved by issuing a direction upon the respondent no.2 to consider the grievance of the petitioners and pass an appropriate order in accordance with law expeditiously, preferably within a period of two months from the date of communication of this order.
It is expressly clarified that the Court has not expressed its opinion on merit of the case and the authority concerned shall pass an order independently in accordance with law.
No order as to costs.
