Heard learned counsel for the petitioner and learned A.G.A. for the State respondents.
This writ petition has been filed praying for the following main relief:
"1. Issue a writ, order or direction in the nature of mandamus directing the respondents, especially respondent No. 1 and 2 to transfer the investigation of Case Crime No. 626/2020 under Sections 307, 341, 323, 504, 506, 34 IPC, P.S. Vibhuti Khand, District Lucknow (East) and Case Crime No. 705 of 2020 under Sections 504, 506 IPC, Police Station Kavi Nagar, District Ghaziabad to any independent agency/C.B.C.I.D. so that justice may be done.
2. Issue a writ, order or direction in the nature of mandamus directing the respondents especially respondent No. 1 and 2 to forthwith decide the representation dated 30.7.2021 submitted by the petitioner. "
Shri G.P. Singh, learned A.G.A. very fairly states that in case the aforementioned representation is pending for consideration, the same will be considered and decided expeditiously.
In the facts and circumstances, no useful purpose would be served in keeping the writ petition pending for consideration and without adverting on the merit of the case, the writ petition stands disposed of finally with the direction to the respondent No. 2-Director General of Police (U.P.), Government of U.P. Lucknow to decide the aforementioned representation of the petitioner strictly in accordance with law, as expeditiously as possible and preferably within six weeks from the date of production of a copy of this order before him.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerised copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
