Heard learned counsel for the petitioner and Sri Vikram Bahadur Yadav learned Standing Counsel for the State.
Undisputedly the prayer of the petitioner for promotion to the post of Head Constable could not be attended to on account of currency of an order of punishment dated 24 February 2014. According to the learned Standing Counsel (and which position is not disputed by the learned counsel for the petitioner) for a period of five years from the date of imposition of the order of punishment, the petitioner was not entitled to be considered for promotion. However today when the matter is taken up, the period of five years has evidently elapsed.
In view of the above, learned Standing Counsel states that as and when a fresh promotional exercise is initiated and subject to verification of further records as well as any other orders of punishment that may exist, the claim of the petitioner for promotion shall be duly considered and disposed of in accordance with law.
Accordingly and without going into the merits of the claim of the petitioner, this petition shall stand disposed of in light of the statement noted above.
