Heard learned counsel for parties.
The instant petition which has been preferred by the petitioner, who was employed with the fourth respondent institution, would not lie for the following reasons.
The institution in question is affiliated to the CBSE. The terms and conditions of service of the petitioner are not governed by any statutory rules or regulations. Bearing in mind the decision of the Full Benches of the Court in M.K. Gandhi and Others Vs. Director of Education (Secondary), U.P., Lucknow and Others [(2005) 3 UPLBEC 2187] and Roychan Abraham v. State of U.P. and Others [2019 (3) ADJ 391 (FB)], the writ petition fails and shall stand dismissed.
