The prayer made in the instant petition is for issuing direction to the Appellate Court, before whom Misc. Tax Appeal No. 10 of 2018 is pending, to decide the same within a specified time frame.
A perusal of the order sheet reveals that the service of notice in appeal upon the opposite party was held sufficient by order dated 9.4.2019, but the opposite party is not appearing before the Appellate Court. The Appellate Court is, therefore, proceeding ex-parte against the opposite party. However, the appeal has yet not been decided.
Having regard to the above facts, the instant petition is disposed of with direction to the Appellate Court to decide the appeal expeditiously, by fixing short dates and without unnecessary adjournments, provided there is no legal impediment.
