Heard learned counsel for the applicant, learned A.G.A. and perused the record.
The only prayer made by the applicant is that a direction be issued to the A.C.J.M IX, Varanasi to decide the application of application u/s 319 Cr.P.C. dated 01.12.2017 as well as trial of Case No.3874 of 2018 (State Vs. Rajesh Singh and others), under Sections 498A, 323, 504, 506, 354 IPC and 3/4 D.P. Act arising out of Case Crime No.369 of 2013, P.S. Shivpur, District Varanasi.
Considering the facts of the case, without expressing any opinion on the merits of the applicant case, A.C.J.M IX Varanasi is directed to decide the application of application u/s 319 Cr.P.C. dated 01.12.2017 as well as trial of Case No.3874 of 2018 (State Vs. Rajesh Singh and others), under Sections 498A, 323, 504, 506, 354 IPC and 3/4 D.P. Act arising out of Case Crime No.369 of 2013, P.S. Shivpur, District Varanasi in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of one year from the date of production of certified copy of this order.
Accordingly, the present application is disposed of.
