JUDGMENT / ORDER

Petition filed under Section 438 Cr.P.C. 2. Petitioners are the accused in Crime No.360 of 2014 of the Kalikavu Police Station, Malappuram, registered for the offences punishable under Sections 376 and 506(ii) IPC r/w 34 IPC.
3. The allegation against the petitioners is that on 10.09.2014 at 10AM, the 1st petitioner committed house trespass into the house of the defacto complainant and committed rape on her. The 1st petitioner is none other than the son of the mother's elder sister of the defacto complainant. On coming to know about it from the 1st petitioner, the 2nd petitioner on 15.09.2014 at 4pm, committed trespass into the house of the defacto complainant and committed rape on her. The 2nd petitioner is none other than the son of the mother's -2-
B.A. No. 8098 of 2014 brother of the defacto complainant. After the incident, it is alleged that the petitioners criminally intimidated the defacto complainant in order to her silence.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. The contents of the CD, prima facie, reveals the complicity of the petitioners. The investigation of the case is not over. The allegations against the petitioners are very grave and serious. It seems that the petitioners were hand in gloves in committing the said acts. Considering the seriousness of the allegations against the petitioners and the present stage of the investigation, I am satisfied that this is not a fit case, where anticipatory bail can be granted to the petitioners.
In the result, this bail application is dismissed.
