The applicant has filed this application for recalling of the order dated 24.09.2012 and for restoring of Misc. Civil Application (Stamp) No.2069 of 2012 which came to be dismissed for non-prosecution on account of non-removal of office objections. Hence, no notice is required to be issued to the otherside.
It is pointed out in the application that the clerk of advocate was on leave and advocate for the applicant was under impression that all office objections are removed.
Considering the explanation given in the application, the order dated 24.09.2012 is recalled. Misc. Civil Application (Stamp) No.2069 of 2012 is restored to file. Office objections shall now be removed on or before 6th March 2013 failing which the matter shall automatically stand dismissed for non-prosecution without reference to the Court. The application stands disposed of.
