Heard learned counsel for applicant and learned A.G.A. for State.
The instant anticipatory bail application has been filed with a prayer to grant an anticipatory bail to the applicant, Abdullah Khan, in Case Crime No.117 of 2017, under Section- 3/7 of Essential Commodities Act and 12/26/30A of the Legal Metrology Act, 2009, Police Station- Aliganj, District- Bareilly.
There is allegation against the applicant that there were tampering found in his petrol/diesel dispensing unit. Learned counsel for applicant has submitted that on the aforesaid allegation, the licence of the petrol/diesel outlet was cancelled. The arbitration proceedings were started and the same was decided in his favour.
The applicant has already filed an application under Section 482 Cr.P.C. No.14369 of 2020 challenging the charge-sheet, which has been disposed of on 12.1.2021.
In view of paragraph-43(8) of the judgement of this Court dated 5.4.2021 passed in Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. No.2110 of 2021 (Shivam Vs. State of U.P. and another), this anticipatory bail application is not maintainable.
It is accordingly rejected.
