JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr.Pujari, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to undertake the repairing of the house and to take care of the health of the mother.
It appears from the jail report that the furlough of the applicant - convict has already become due and the application is forwarded to the competent authority and the decision is being awaited.
Under these circumstances, the competent authority, who is seized with the application for furlough, shall taken appropriate decision within a period of 10 days from today. If the furlough is granted, the cause for the present application would not survive. Hence, no further orders at this stage. Subject to the aforesaid direction, the application is disposed of. Rule discharged.
