JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) 1.0 Inspite of the public time of the Court having been invested on several earlier occasions and the order dated 24th April 2012, learned counsel Mr. P. M. Bhatt appearing with learned counsel Mr. Y. M. Bhatt has repeated the same submissions and arguments for the third time, stating that he would put his house in order and supply the missing papers and documents in the files of the Court. It has been noticed in April 2012 that in the first set of papers in Special Civil Application No. 12690 of 2008, papers at page Nos. 66 to 140 have been missing. In the second set of the same matter, the file ends at page No. 65. All this is known to learned counsel at least for three months and he has taken repeated adjournments saying the same thing viz. 'I will put my house in order'. Nothing is done so far while the petitions are already listed for 73 times for hearing. It is sheer waste of public time of the Court at the instance of learned counsel for the petitioners and even today, learned counsel is not in a position to argue in view of the state of his own files and the files of the Court.
2.0 Under the circumstances, hearing is adjourned to 11th September 2012. Interim relief operating in the petitions is vacated and learned counsel is directed to pay to the Legal Services Authority Rs.2,500/- (Rupees Two thousand five hundred only) by way of cost.
