(Per : HONOURABLE MR.JUSTICE A.L.DAVE) Learned Advocate Mr.Bhatt for the petitioners states that these matters were extensively argued before another coordinate Bench, who has passed an order treating the same as 'part-heard matter'. He has drawn our attention to order dated 05/04/2011 passed in SCA No.12690 of 2008 and allied matters where the Court observed thus:
"... Thus, the petitions are partly heard and ordered to be listed for final hearing on 19.04.2011 as suggested by learned counsel."
The said order was passed by a Division Bench comprising of Hon'ble Justice D H Waghela and Justice K A Puj, one of whom has now retired. Office is, therefore, directed to place these matters before the Hon'ble the Acting Chief Justice for passing appropriate orders.
