Petitioner is accused in Crime No.455 of 2014 of the Tirurangadi Police Station for the offences punishable under Sections 143, 147, 148, 341, 323, 308 and 506(i) r/w Section 149 of the Indian Penal Code, apprehends arrest and has filed this application.
2. Application is opposed by the learned Public Prosecutor. It is submitted that on 10.04.2014 at about 04.00 p.m. the petitioner and others assaulted the de facto complainant with wooden reaper. Learned Public Prosecutor has submitted that some of the accused are yet to identified and the wooden reaper is to be recovered.
3. Learned counsel submits that the allegations against the petitioner are not true. The case was registered only on 13.04.2014. The petitioner is falsely implicated since the de facto complainant is the personal staff of the Minister for Education. The injuries allegedly suffered are not serious.
4. Since some of the accused are yet to be identified and the alleged weapon of offence is yet to be recovered, B.A.No.3230 of 2014 2 request for pre-arrest bail cannot be allowed.
It is directed that in case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of with the above direction.
