Heard learned counsel for the petitioner and perused the record.
By means of this writ petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"i). Issue a order or direction to Civil Judge (Senior Division) Banda to expedite the application under Section 6 (Ga) (2) dated 8th March, 2021 under Order 39 Rule 1 and Sub Rule 2 of the C.P.C. in Civil Original Suit No.59 of 2021 (Abdul Shakur vs. Varish and others) pending before the Civil Judge (Senior Division) Banda within a stipulated period or next date fixed and till the disposal of aforesaid application status quo shall be maintained."
Accordingly, this petition is disposed of with a direction to the court concerned to consider and decide the aforesaid 6 (Ga) (2) application of the petitioner dated 8th March, 2021 under Order 39 Rule 1 and Sub Rule 2 of Code of Civil Procedure, 1908 strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of two months from the date of production of copy of this order.
It is provided that a copy of the order available on the official website of the High Court will be taken to be authentic one.
