CHANDRA KUMAR WRIT PETITION NO. 4850 OF 2013 O R D E R :
The father of the petitioner, late Abdul Saleem, E-57499, Ex-Driver of Dubbaka Bus depot died on 01-02-2007. It appears that he was removed from service vide Proceedings dated 04-10-2005 by the third respondent. When he was unsuccessful in appeal, he filed a review petition and the same was considered and he was reinstated into service afresh as driver. Challenging the said order, he approached the Labour Court and an award dated 18-06-2010 was passed in ID.No. 19 of 2008 setting aside the removal order passed by the third respondent and further declaring that the legal heirs of the deceased employee is entitled to all consequential benefits. It is also observed by the Labour Court that the death of the deceased, Abdul Saleem is to be treated as that of he died during harness and accordingly the petitioners 1 to 6 in that I.D. are entitled for all benefits.

According to the learned counsel for the petitioner, all the legal heirs of the deceased have jointly submitted no objection affidavit to the respondents requesting them to appoint the petitioner, who is the elder son of the deceased in a suitable post. They have categorically stated that they have not availed any monetary benefits in lieu of employment.
3. In the above circumstances, the respondents are directed to consider the case of the petitioner and appoint him on compassionate ground in any suitable post within six weeks from the date of receipt of a copy of this order.
4. With the above direction, the writ petition is disposed of accordingly. No costs.
