JUDGMENT / ORDER

[Order of the Court was made by R.SUBBIAH, J] The present Contempt Petition has been filed alleging non-compliance of the order passed by this Court dated 16.04.2013, made in W.P.(MD)No.6130 of 2013.
2. This Court, by judgment dated 16.04.2013, directed the Tahsildar, to consider the representation of the petitioner and pass orders on merits and in accordance with law, after giving opportunity of hearing to the petitioner as well as to the respondents 5 and 6 in the Writ Petition and the persons who are likely to be affected, within a period of six weeks. Since the said order has not been complied with, the petitioner has come up with the present Contempt Petition.
3. It has been stated by the petitioner that pursuant to the order passed by this Court dated 16.04.2013, in W.P.(MD)No.6130 of 2013, the Tahsildar, by proceedings in Na.Ka.Aa9-20381-2013, dated 02.08.2013, directed the Executive Officer of Selection Grade Town Panchayat, Thiruppathur, Sivagangai District, to take steps to provide 3.2m broad way on the western side of the land at S.No.272-10A to an extent of 0.00.50 square metres. The Executive Officer issued a notice to Tmt.Indirani, the fifth respondent in the Writ Petition, vide Na.Ka.No.350/2012, dated 02.09.2013, to remove the encroachment in Survey No.272-10A to the extent of 0.00.50 square metres. Thereafter, the Executive Officer sent a letter to the respondent vide Na.Ka.No.350/2012, dated 03.01.2014, requesting to cancel the patta in the name of Tmt.Indirani, with respect to the land at Survey No.272-10A. However, the respondent did not pass any order so far. Hence, the petitioner has come up with the present Contempt Petition.

Today, when the Contempt Petition was taken up for consideration, the learned Government Advocate submitted that on 12.11.2014 in the presence of Village Administrative Officer, the revenue officials have removed the encroachment to an extent of 5.5 feet breadth. He has also produced a photograph for perusal of this Court. Thus, he submitted that the order of this Court dated 16.04.2013 has been complied with.
5. In view of the submission made by the learned Government Advocate, since the order has been complied with, the Contempt Petition is closed as nothing survives for adjudication.
