Heard learned counsel for the petitioner and learned Standing Counsel. Shri Vivek Verma and Shri Rajesh Kumar Singh appear for contesting respondents.
In pith and substance the plaintiff-petitioner is before this Court for a direction to first respondent to decide Execution Case No.17 of 2015 (Peer Mohd. v. K.D.A.) within stipulated period.
Shri Vivek Verma, learned counsel for development authority states that the development authority has every right to agitate and put their case before the execution court and as such no time period may be fixed for deciding the execution case.
Considering the facts and circumstances of the case and without expressing any opinion on the merits of the issue, the writ petition stands disposed of finally with a direction to first respondent to consider and decide the aforesaid execution case in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
