The grievance of the petitioner is that despite affirmance of the decree by this Court in Second Appeal No. 1346 of 1991, the execution proceedings are pending since the year 1991 as Execution Case No. 16 of 1991.
The prayer therefore is that a direction upon the court concerned to bring the execution proceedings to its logical conclusion within stipulated period.
Without expressing any opinion whether there is any legal impediment in continuing with the execution proceeding, this petition is disposed off by providing that the execution court shall ascertain whether there is any legal impediment in bringing the execution proceeding to its logical conclusion or not and if there is no legal impediment it shall proceed with the execution expeditiously, without entertaining unnecessary adjournments from the parties, and endeavour to bring the same to its logical conclusion.
