Heard Sri Pankaj Kumar Govil, learned counsel for the petitioners, learned Standing Counsel for the respondents Nos.
1 and 3 and Sri Ashish Mishra, learned counsel for the respondent No.4.
By means of this writ petition, the petitioners claim that they had participated in e-auction of shop no.33 and shop no.12 by submitting the bid of Rs.88.23 Lakhs and Rs.71.23 Lakhs respectively. Being the highest bidder the shops were allotted to the petitioners. 50% of the bid amount was to be deposited instantly and remaining 50% was to be deposited within three months. The petitioners defaulted in payment and now have come to this Court that they may be allowed some time to deposit the entire amount since the allotment has been made in their favour.
Sri Ashish Mishra, learned counsel appearing for the respondent No.4-Secretary, Krishi Utpadan Mandi Samiti submits that on account of non-deposit of the amount the allotment has already been cancelled by order dated 25.10.2018. He has shown us the said order.
That being the case, the allotment having been already cancelled. The prayer sought for in this writ petition cannot be granted.
The writ petition is, accordingly, dismissed.
