The writ petitioner herein is the complainant in Crime No.480/2014 of the Perumbadappu Police Station, registered under Section 341, 323 and 324 of the Indian Penal Code. His complaint is that he was brutally assaulted by some head load workers in an attempt on his life. He brought this writ petition for a writ of mandamus directing the police to incorporate appropriate sections including Section 307 of the Indian Penal Code. Now it is reported that during investigation the offence punishable under Section 326 of IPC was revealed, and the investigating officer has accordingly filed a report before the learned Magistrate. Sections cannot be incorporated as desired by the complainant. Anyway, on the basis of materials, the police has now incorporated Section 326 of the Indian Penal Code. Now the learned counsel for the petitioner submits that the petitioner is satisfied, and that the writ petition could be closed.
In the result, the police report regarding incorporation of Section 326 of the Indian Penal Code in the proceeding is recorded, and the writ petition is closed.
