JUDGMENT / ORDER

The petitioner has submitted an application for renewal of his licence for conducting a coffee curing mill. The petitioner was earlier issued with Ext.P6 licence that was valid till 31.3.2014. The petitioner's application for licence has been acknowledged receipt of by Ext.P7. According to the petitioner, no orders have been passed thereon till date. Without passing any orders on the petitioner's application for licence, he was issued with Ext.P8 notice directing him to show cause why action should not be taken against him for conducting his establishment without a valid Panchayat licence. The petitioner has already submitted his explanation, Ext.P9. However, the petitioner complains that no orders have been passed in the matter. His application for licence is also pending consideration of the third respondent. The petitioner therefore seeks the issue of appropriate directions for the consideration of his application. In view of the limited relief sought, I do not consider it necessary to issue notice to respondents 2 and 3. The Govt. Pleader takes notice for the first respondent. 2. This writ petition is therefore disposed of with the following directions:-
i) The third respondent is directed to consider the petitioner's application for licence, acknowledged receipt of by Ext.P7, in accordance with law and to pass appropriate orders thereon, as expeditiously as possible and at any rate within a period of one month of the date of receipt of a copy of this judgment.
ii) The third respondent is further directed to consider Ext.P9 explanation submitted by the petitioner and to finalise the proceedings initiated as per Ext.P8. The proceedings shall be finalised as expeditiously as possible and at any rate within a period of one month of the date of receipt of a copy of this judgment. Pending disposal of the application submitted by the petitioner, respondents 2 and 3 shall not initiate any coercive action against the conduct of his business.
