HONOURABLE SRI JUSTICE S.RAVI KUMAR CIVIL REVISION PETITION No.1062 OF 2005 ORDER:
This revision is against order dated 14-2-2005 in R.A.No.158 of 2003 on the file of Chief Judge, City Small Causes Court, Hyderabad.
Brief facts leading to this revision are as follows:
Petitioners herein are tenants and respondents 1 and 2 herein are landlords.
Landlords filed R.C.No.473 of 1996 for eviction and that was allowed on 27-4-1998 and aggrieved by the same, petitioners i.e., tenants filed I.A.No.483 of 1998 to set aside the ex parte order and that the petition was dismissed by order dated 7-7-2003. Against that, the tenants preferred appeal in R.A.No.158 of 2003 before Chief Judge, City Small Causes Court, Hyderabad and the Chief Judge after considering the objections of both sides, dismissed the appeal confirming order of the Rent Controller. Now aggrieved by the same, present revision is preferred.
None appeared for the revision petitioners.
Advocate for respondents 1 and 2 submitted that the tenants have vacated and possession was delivered through court in execution of eviction order on 1-3-2005.
As seen from the record, this revision is filed on 3-3-
2005 i.e., after delivery of possession.
Recording the representation of the counsel for respondents 1 and 2, this revision is dismissed as the possession was already delivered and no cause survives.
Therefore, this Civil Revision Petition is dismissed.
No order as to costs.
As a sequel to the disposal of this revision, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
