The Courts below have concurrently dismissed the suit for permanent prohibitory injunction. The allegation of the defendants is that the construction of the compound wall is unauthorised. The plaintiff has evidently not succeeded in establishing absolute possession over the land including the compound wall. The finding based on possession is rested on evidence and calls for no interference in this regular second appeal.
2. This will not however preclude the plaintiff from filing a fresh suit for declaration of title and for demarcation of boundary and other consequential reliefs.
The regular second appeal is dismissed.
