1. Heard learned counsel for petitioner, learned Standing Counsel for State-respondents and Sri V.K. Dubey, learned counsel for respondent 4.
2. Petitioner claims that one Santosh Kumar, not a party in this Public Interest Litigation (PIL), has been wrongly appointed on contract / daily basis and he should be removed from service and recovery of salary. In this regard, he has made representation to Chief Minister, Uttar Pradesh and seeking mandamus to direct respondent 2-Principal Secretary, Urban Development Government of U.P. to decide the same.
3. Learned counsel for respondents states this petition as Public Interest Litigation is not maintainable in service matter and remedy lies to file a writ of quo-warranto challenging appointment order, if made illegal.
4. This Public Interest Litigation is misconceived and it is, accordingly, dismissed.
