This Court vide order dated 25.09.2018 directed the opposite party to consider the case of the applicant under Section 152 of the Electricity Act.
Pursuant thereof the competent authority vide order dated 27.11.2018 has assessed the applicant under Section 126 of the Electricity Act.
In this backdrop, learned counsel for the applicant submits that the opposite party has flouted the order of this Court.
The submission advanced by the learned counsel for the applicant, in my opinion, is misconceived. It is not the case of the applicant that the applicant cannot be assessed under Section 126 of the Electricity Act.
In view thereof, the petition is dismissed with liberty to the applicant to take remedy against the order passed by the opposite party before the appropriate forum.
