JUDGMENT / ORDER

Application filed under Section 438 of the Code of Criminal Procedure.
2. Petitioner is the 2nd accused in Crime No.824 of 2014 of the Nilambur Police Station registered for the offences punishable under Sections 420, 465, 466, 468 and 471 r/w Section 34 of the Indian Penal Code.
3. The allegation against the petitioner is that he is conducting a driving school in Chandakunnu, Nilambur and he used to forge false school certificates for enabling persons to obtain licence and badge from the Motor Vehicles Department. Similarly, in the present case, he had aided the first accused in procuring licence and badge by producing false S.S.L.C certificate and other supporting false documents.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor. I have perused the C.D.
5. The contents of the CD prima facie reveal the complicity of the petitioner. The allegations against the petitioner are very grave and serious. Learned Public Prosecutor has pointed out that in a search conducted at the

2 office premises of the petitioner, 31 similar forged documents were seized from his possession. Considering the seriousness of the allegations against the petitioner, and the facts and circumstances of the case, I am of the view that this is not a fit case wherein anticipatory bail can be granted to the petitioner.
6. The learned counsel for the petitioner seeks for an opportunity to the petitioner to surrender before the investigating officer. The petitioner may, if so advised, surrender before the investigating officer within five days from today and in such case, after interrogation, without delay the petitioner shall be produced before the jurisdictional magistrate. In case advance notice is served on the learned Assistant Public Prosecutor in charge of the case, the learned magistrate shall dispose of the application seeking bail if any filed, preferably on the same day itself.
In the result, this bail application is dismissed.
