JUDGMENT / ORDER

The petitioners are the accused in C.C.No.1129/2013 on the file of the court of Chief Judicial Magistrate, Thalassery. Kulavallur police has registered Crime No.78/2013 alleging offences under sections 498(A), 406 r/w 34 IPC.
2. Heard the learned counsel for the petitioners and the learned counsel for the de facto complainant.
3. The de facto complainant is the wife of the 1st petitioner. Annexure IV agreement is produced to show that the disputes relating to maintenance and other rights of a divorced Muslim wife have been settled between the parties. The learned counsel for the de facto complainant submitted that as per Annexure V affidavit, the de facto complainant has clearly expressed that she has no Crl.M.C.No.2604 of 2014 2 subsisting grievance against her former husband (the 1st accused). The other accused petitioners are relatives of the 1st accused. Disputes in relation to those accused also have been settled. Therefore, further prosecution of the case will result in the benefit to none of the parties. Therefore, this petition is allowed and Annexure III final report in Crime No.78/2013 of Kulavallur police station, pending in C.C.No.1129/2013 on the file of the court of Chief Judicial Magistrate, Thalassery is hereby quashed.
