The petitioner is a contract carriage permit holder plying his autorickshaw in the Manjeri Municipality. He sought for variation of permit, the application for which was refused to be accepted on the ground that the RTA, Malappuram, has directed restriction of autorickshaw permit within the Malappuram Municipality area. This Court has in Rajesh v. Secretary, RTA [2014 (3) KLT 341], held that such general orders cannot be passed by the RTA and each application has to be considered individually and a reasoned order passed under Section 80(2) of the Kerala Motor Vehicles Act, 1988.
2. In such circumstances, the application filed by the petitioner shall be accepted to the files of the RTA, Malappuram and the same shall be considered within a W.P.(C) No.30279 of 2014 -: 2 :-
period of two months from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
