This writ petition has been filed alleging unauthorised construction by the 4th respondent. Indisputably, pending the writ petition, the said construction was regularised by the competent authority under the first respondent. Admittedly, the petitioner has already preferred an appeal against the order of regularisation availing the statutory remedy before the Tribunal for Local Self Government Institutions. In the said circumstances, it is for the petitioner to pursue with the said appeal. Therefore, without prejudice to the right of the petitioner to pursue with the appeal preferred against the order of regularisation and making it clear that the said order of regularisation will be subject to the outcome of the said appeal, this writ petition is closed.
