Heard learned counsel for the petitioner and Sri Harish Chand Dubey, learned Standing Counsel for the State-respondents.
The petitioner wants an injunction against the State- respondents. Neither in the writ petition nor from any documents attached to this petition, counsel for the petitioner has been able to show that the land over which constructions have been raised belong to the petitioner or is the registered Abadi of the Village.
In such circumstances, we are not inclined to entertain this petition even for a direction to the District Administration to decide his representation.
Petitioner would be free to avail such remedy as may be available to him by filing a civil suit for injunction or declaration for appropriate relief but not petition under Article 226 of the Constitution.
Petition is accordingly dismissed.
