Heard learned counsel for the applicant, Sri Mahboob Ahmad, learned counsel for opposite party No.2 and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the cognizance order dated 25.06.2018 and entire proceedings of Case No. 338 of 2018 (State Vs. Abdul Jabbar ), arising out of Case Crime No. 294 of 2012, under Section- 135 of Electricity Act, Police Station- Mau Aima, District- Allahabad, pending in the court of Special Judge, E.C. Act, Allahabad.
It is submitted by learned counsel for applicant that offence lodged against the applicant is compounding in nature.
It is directed that if compounding fess is deposited within one month from today, Court below shall consider compounding application of applicant within two months thereafter.
Till compounding application is decided, no coercive measure shall be taken against the applicant in aforesaid case.
However, in case of failure to comply this order, Court below shall be at liberty to proceed against the applicant in accordance with law.
With the aforesaid observations, this application is disposed of.
