The petitioner is a stage carriage operator conducting services on the route Puthensanketham - Bharanikavu with a stage carriage bearing Registration No.KL 11/Z 1212. He had applied for variation of the regular permit by curtailing one trip and by incorporating an additional trip and further by extending one of his routes. The petitioner complains that by Ext.P4, the consideration of his application has been postponed. The matter has been pending from 11.02.2014, with no further action thereon. The petitioner therefore seeks the issue of appropriate directions to finalise the proceedings.
2. The learned Government Pleader on instructions submits that the report of the Filed Officer that was available, was silent on certain aspects. Therefore, a second report has been called for. The said report is awaited. Time has been consumed for the reason that, the question of overlapping on the notified route required to be probed. However, the proceedings would be finalised within a period of one month.
The writ petition is therefore disposed of directing the 1st respondent to take a final decision on the application submitted by the petitioner for variation, in accordance with law, as expeditiously as possible and at any rate within a period of one month of the date of receipt of a copy of this judgment.
